Terms and Conditions

1. Sales Employees Motivation Promotions (“Promotion”) are open to sales employees, aged 18 or over, of UK wholesaler depots stocking Unilever Foodsolutions products (“Product”). Promotions are not open to employees of the Promoter, their families, agents or anyone professionally connected with the Promotions. Employees of publicly-funded bodies and their families are also excluded.

2. Promotions are organised on an individual basis at wholesaler depots by the Unilever Foodsolutions representatives (“Representative”) assigned to the depot. It is in the sole discretion of the Representative to organise such Promotions and he/she is not obliged to organise a Promotion at his depot, simply because the same Promotion is being run in other depots.

3. To be eligible for a gift or win a prize, participants will be required to sell for a limited period a minimum number of cases of a Product as specified by the Representative. Where in one Promotion gifts and prizes are to be awarded, the Representative shall distinguish the gifts from the prizes. In such Promotions, to win a prize, participants will be required to sell a higher number of cases of the Product, than that required to be eligible for a gift. 

4. Prizes or gifts may give rise to tax implications which are the responsibility of the recipients of the gifts (“Recipient”) or the winners of the prizes (“Winner”). It is the responsibility of all participants to verify their tax position.

5. In the event of unforeseen circumstances the Promoter reserves the right to substitute the prize for an alternative of equal or greater value. No correspondence will be entered into.

6. Entry forms will be provided by the Representative, which should be returned to the Representative, via the depot manager or in a manner specified by him. All entry forms should be returned before the closing date for receipt of entries which shall be specified on the entry form or by the Representative.

7. No photocopies of the entry form will be accepted, unless it is stated otherwise on the entry form. No entries from agents, third parties, organised groups or applications automatically generated by computer will be accepted. Incomplete or illegible entries or those not in accordance with the entry instructions will not be accepted.

8. Responsibility is not accepted for entries lost, damaged or delayed in the post. Proof of posting will not be accepted as proof of receipt. Entries will become the property of the Promoter and will not be returned.

9. Winners will be notified by the Representative or by whatever method of communication is indicated on the entry form.

10. Winners must claim their prize within 30 days of notification. If the prize remains unclaimed after this time, it will lapse and the Promoter reserves the right to offer the unclaimed prize to a substitute winner selected in accordance with the Promotion rules.

11. All gifts and prizes shall be delivered to recipients and winners at the wholesaler depot address within 28 days of the claim.

12. Winners’ details (name and county) will be made available on request to those enclosing a stamped SAE to an address provided by the Representative within six weeks after the published closing date.

13. Before or at the time of entry of each Promotion, the Representative shall make available to participants the following information:

• the minimum number of cases of Products to sell to be eligible for a gift or to win a prize;
• details of the gifts and/or prizes;
• the Promotion period;
• the closing date for receipt of entries;
• how to return the entry forms;
• how the Winners will be notified and when; and
• how to obtain the Winners’ details.

14. Winners may be required to participate in publicity arising from this Promotion.

15. By entering the Promotions, all participants will be deemed to have accepted and be bound by the rules and consent to the transfer of their personal data to the Data Controller for the purposes of the administration of the Promotions and any other purposes to which the entrant has consented. All entry instructions form part of the rules.

16. These terms and conditions shall be governed by English law and the courts of England and Wales shall have exclusive jurisdiction.
